The Delhi High Court quashed the FIR registered after a dispute between friends, directing both parties to do community service in a hospital in Manipur. The High Court has given this direction after the dispute was resolved amicably between the two parties.
There is no more conflict between the two sides.
The Delhi High Court said that the complainant and the two accused are still friends. There are currently no existing grievances between them. Therefore, the chances of conviction in this case are very low and continuing the criminal proceedings will not serve any purpose.
In my opinion, it would be appropriate to grant the sought relief of quashing the FIR subject to the condition of community service and payment of appropriate compensation. The petitioner and respondent No. 4 (both accused) will have to do community service in 6 sessions of 2 hours each at the Regional Institute of Medical Sciences, Manipur: Justice Pratik Jalan
Certificate from hospital will have to be submitted to the court
The Delhi High Court said that the two friends will have to report to the Medical Superintendent of the hospital, who will give them suitable work. These 6 sessions will have to be completed in 2 months from the date of commencement of community service. After this, the Medical Superintendent will give them a compliance certificate, which will be put in the court record.
The FIR of this case was registered at Dabri police station
The high court also directed the two accused to pay a sum of Rs 10,000 to the Delhi High Court Bar Association in two weeks. It is worth mentioning that this order was given while approving the petition related to the appeal to cancel the FIR registered at the Dabri police station here.
The flat was forcibly entered and assaulted.
It is to be noted that this FIR was registered on the complaint of a person in March last year. The complainant alleged that he was living in a rented flat with his friend. At that time, both the accused forcibly came to the house and beat him and his friend.
The two sides reached an agreement without any pressure.
Now the High Court was told that both the parties have resolved the dispute without any pressure or undue influence. Also, a reconciliation agreement has also been signed. Besides, the person who was injured in the incident also told the High Court that he has recovered from his injury and has not suffered any permanent side effects. Both sides said they are still friends and have no existing grievances against each other. Earlier, the court had acquitted the accused in a case of theft of chairs, coolers and mattresses from the MP’s official bungalow.
